1. Introduction

Welcome to MF Stream, a premium streaming platform operated by Matinee Films Private Limited ("MF Stream", "we", "our", or "us").

These Terms of Use ("Terms") govern your access to and use of the MF Stream website, mobile applications, smart TV applications, and any other digital services or platforms operated by MF Stream (collectively, the "Platform").

By accessing, browsing, registering for an account, subscribing to, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use, together with our Privacy Policy and Cookie Policy.

If you do not agree with any part of these Terms, you should discontinue your use of the Platform immediately.

2. Definitions

For the purposes of these Terms of Use:

"Platform" means the MF Stream website, mobile applications, smart TV applications, and all digital services operated by Matinee Films Private Limited.

3. Acceptance of these Terms

By creating an account or using the Platform, you confirm that:

You must not share your account credentials with individuals outside your household or permit unauthorised access to your account.

MF Stream reserves the right to limit simultaneous streaming, monitor unusual account activity, and suspend or terminate accounts where unauthorised account sharing or misuse is detected.

Where applicable, simultaneous streaming limits will depend on your selected subscription plan.

7. Subscription Plans

MF Stream offers subscription-based access to premium content.

Subscription plans, pricing, features, and availability may vary from time to time and may differ based on location, promotional offers, or other factors.

Your subscription entitles you to access eligible Content only for your personal, non-commercial use, subject to these Terms.

Certain films or programmes may not be available in all regions due to licensing or legal restrictions.

MF Stream reserves the right to modify, introduce, suspend, or discontinue subscription plans, pricing, promotional offers, or Platform features at its sole discretion.

8. Payments and Billing

Subscription payments are processed securely through authorised payment service providers, including Razorpay.

By purchasing a subscription, you authorise the applicable payment provider to process the payment using your selected payment method.

MF Stream does not store your complete debit card, credit card, banking, or UPI credentials.

Subscription fees are charged in accordance with the plan selected by you and are generally non-refundable unless otherwise required by applicable law or expressly stated by MF Stream.

You are responsible for ensuring that your payment information remains accurate and up to date.

Failure to process payment successfully may result in suspension or cancellation of your subscription benefits until payment is received.

9. Refunds and Cancellation

Unless otherwise required by applicable law, subscription fees paid to MF Stream are non-refundable.

You may cancel your subscription at any time through your account settings or the applicable payment platform. Cancellation will take effect at the end of your current billing period unless otherwise specified.

No refunds or credits will be provided for partially used subscription periods, unused viewing time, or remaining subscription periods, except where required by applicable law or expressly approved by MF Stream.

10. Permitted Use of the Platform

MF Stream grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes, subject to these Terms of Use.

You may access the Platform only through supported devices and authorised applications made available or approved by MF Stream.

Your access to the Platform does not grant you any ownership rights in the Platform, its Content, or any associated intellectual property.

11. Intellectual Property Rights

All Content available on the Platform, including but not limited to films, documentaries, trailers, promotional materials, graphics, logos, trademarks, software, designs, artwork, subtitles, audio, video, text, metadata, and all other materials, is owned by or licensed to Matinee Films Private Limited or its respective licensors and is protected under applicable copyright, trademark, and other intellectual property laws.

Except as expressly permitted under these Terms, you may not:

Copy, reproduce, distribute, or republish any Content.
Download, save, or permanently store Content unless expressly permitted by MF Stream.
Record, screen capture, photograph, or otherwise reproduce any Content during streaming.
Modify, edit, translate, adapt, or create derivative works from any Content.
Sell, rent, lease, sublicense, assign, or commercially exploit any part of the Platform or its Content.
Remove or alter any copyright, trademark, watermark, or proprietary notices.
Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Platform or any related software, except where expressly permitted by applicable law.

All rights not expressly granted under these Terms are reserved by MF Stream and its licensors.

12. Copyright Complaints

MF Stream respects the intellectual property rights of content creators, licensors, and third parties.

If you believe that any Content available on the Platform infringes your copyright or other intellectual property rights, you may submit a written notice to us containing sufficient details to investigate the matter.

Upon receiving a valid complaint, MF Stream will review the matter and, where appropriate, may remove, disable access to, or otherwise take action regarding the disputed Content in accordance with applicable law.

13. Content Availability

MF Stream continuously updates its catalogue to provide a diverse and engaging viewing experience.

Content available on the Platform may change from time to time without prior notice due to:

MF Stream will make reasonable efforts to provide uninterrupted, high-quality streaming but does not guarantee continuous availability or compatibility with every device, browser, operating system, or internet connection.

Periodic maintenance, software updates, and technical improvements may temporarily affect access to the Platform.

15. Service Availability

MF Stream strives to provide reliable and uninterrupted access to the Platform. However, access to the Platform or certain features may be temporarily unavailable due to scheduled maintenance, software updates, system upgrades, technical issues, security enhancements, network failures, or events beyond our reasonable control.

We will make reasonable efforts to minimise any disruption and restore services as quickly as practicable. However, MF Stream does not guarantee uninterrupted, continuous, or error-free access to the Platform at all times.

When using MF Stream, you agree to:

To the fullest extent permitted by applicable law, Matinee Films Private Limited, its directors, employees, affiliates, licensors, partners, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to:

Temporary interruption or unavailability of the Platform.
Delay or failure in streaming services.
Loss of data, profits, goodwill, or business opportunities.
Unauthorised access to your account resulting from your failure to protect your login credentials.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

23. Indemnification

You agree to indemnify, defend, and hold harmless Matinee Films Private Limited, its directors, officers, employees, affiliates, licensors, partners, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

Payment for your subscription cannot be successfully processed.

You may discontinue using the Platform or cancel your subscription at any time, subject to the applicable subscription terms.

Termination of your account does not affect any rights or obligations accrued before the date of termination.

25. Force Majeure

MF Stream shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms of Use where such delay or failure results from events beyond its reasonable control. Such events may include, but are not limited to:

Natural disasters, floods, earthquakes, storms, or other acts of nature.
Fire, explosions, or accidents.
War, terrorism, civil unrest, riots, or government actions.
Epidemics, pandemics, or public health emergencies.
Power failures, internet or telecommunications outages.
Cyberattacks, hacking incidents, or other security events beyond our reasonable control.
Labour disputes, strikes, lockouts, or shortages of materials or services.

MF Stream will make reasonable efforts to restore its services as soon as practicable following the occurrence of such an event.

26. Governing Law and Jurisdiction

These Terms of Use shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Ernakulam, Kerala, India, unless otherwise required by applicable law.

27. Changes to these Terms

MF Stream may revise or update these Terms of Use from time to time to reflect changes in our services, technology, legal requirements, or business practices.

Any revised Terms will be published on the Platform together with the updated Effective Date.

Your continued use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Failure by MF Stream to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights available to MF Stream under applicable law.
